Fly Tipping Leaves Resident with £200 Fixed Penalty Notice

East Staffordshire Borough Council’s Enforcement Team has recently issued a £200 Fixed Penalty Notice to a resident whose waste was later found to be fly tipped at Mill Stream Lane, Burton on Trent.

The waste was a result of a property being cleared out involving several journeys by the person employed taking the waste and fly tipping it.

An investigation is underway to identify the male who fly tipped the waste, who will be held to account.

Residents are reminded to ensure that they are covered when handing their waste to another person to avoid fines or prosecution action and to ask the waste carrier to provide their full address and telephone number, ask to see their waste carrier licence issued by the Environment Agency and contact the Environment Agency directly on 03708 506 506 or through their website to confirm the licence is current.

Ask how the waste is being disposed of, make sure the person is a licensed waste carrier with the Environment Agency and ask for waste transfer notes including the person’s details.

Cllr Bernard Peters, Cabinet Member for Communities and Housing Standards, said: “We have seen an increase of fly tipping in the Borough and are keen to hold anyone found to be committing a fly tipping offence to account. Fly tipping can range from a single black bag to a single item such as a wardrobe, a freezer or a mattress through to a large scale deposit of builders waste.

The Teams will use their full remit of powers to tackle the tippers. Anyone found to be fly tipping can receive a Fixed Penalty Notice, be prosecuted or have their vehicle seized. We also are using mobile CCTV cameras in order to gather evidence of the perpetrators.

We would remind residents to be careful when they are employing a person to remove their waste and take all the necessary steps to make sure they are licensed and that their waste does not end up being fly tipped or else they may receive a Fixed Penalty Notice or be prosecuted”.
