New Validation Checklist for Planning Applications
We have considered your comments and suggestions on our draft Validation Checklist and this has now been revised to take these into account where appropriate. Thank you for your help in updating and improving this important document.
The new checklist is now adopted and will come into effect on 4th January 2011.

Householder Planning Enquiries (Do I need planning permission?)
Please Note:
As of the 17th January 2011, it will no longer be possible for the Council, as Local Planning Authority to provide 'free' informal written advice as to whether or not planning permission is required for householder developments i.e. including extensions to dwellings or outbuildings and other development within gardens.
Therefore, after this date, should you require confirmation from the Council regarding such proposed householder developments it will be necessary for you to submit a formal application under Section 192 of the Town and Country Planning Act 1990 (as amended), for a Certificate of Lawfulness of Proposed Development.
You will appreciate that a Certificate of Lawfulness for Proposed Development (CLPD) is a formal application that attracts a fee of £75 for householder developments which is half the amount that would be payable in respect of an application for planning permission to carry out the development. In addition, with the application, you will be required to complete an application form and submit this together with 4 sets of plans (drawn to a scale of 1:50 or 1:100), including a site location plan with the site outlined in red and existing and proposed elevation and floor plans of the property. Application forms for a Certificate of Lawfulness for Proposed Development may be obtained from the website www.eaststaffsbc.gov.uk, the Planning Portal www.planningportal.gov.uk or from the Customer Services Centre, Market Place, Burton upon Trent or Uttoxeter Library, Red Gables, High Street, Uttoxeter.
In view of the above, any correspondence relating to 'permitted development' enquiries for householder developments received from the 17th January 2011 onwards will not be replied to, and you will accordingly be advised of the need to submit a Certificate of Lawfulness for Proposed Development application.

Saved Local Plan Policies July 2009
The Council’s adopted local plan, part of the development plan covering East Staffordshire, and the basis for determining all planning applications received by the authority, was adopted on 20th July 2006. When adopted, the plan was ‘saved’ for three years under the transitional arrangements set out in the Planning and Compulsory Purchase Act 2004. The Council has now received permission from the Secretary of State to retain those policies that are still relevant, are in accordance with current national, regional and structure plan saved policies and are locally specific. The policies listed for retention have met the criteria set out in the Department for Communities and Local Government’s Protocol and are available to view from the General Planning Documents list
