Extensions to time limits for implementing existing planning permissions and Non-material amendments
Following a consultation exercise undertaken by the Department for Communities and Local Government over summer 2009, new provisions have been put in place from 1st October which allow for permissions which are about to lapse to be kept alive via a simplified application procedure. This process covers all permissions.
It is also now possible to apply to make non-material amendments to existing planning permissions under S96a of the Town and Country Planning Act 1990. By accommodating small changes as “non-material amendments” the need to submit a new planning application for minor changes to development proposals is avoided. As an application under S.96A is not an application for planning permission, provisions relating to consultation, publicity and notification do not apply.These provisions do not however, apply to listed building or conservation area consent.

Saved Local Plan Policies July 2009
The Council’s adopted local plan, part of the development plan covering East Staffordshire, and the basis for determining all planning applications received by the authority, was adopted on 20th July 2006. When adopted, the plan was ‘saved’ for three years under the transitional arrangements set out in the Planning and Compulsory Purchase Act 2004. The Council has now received permission from the Secretary of State to retain those policies that are still relevant, are in accordance with current national, regional and structure plan saved policies and are locally specific. The policies listed for retention have met the criteria set out in the Department for Communities and Local Government’s Protocol and are available to view from the General Planning Documents list.
