Before considering the demolition of any building please read the following guidance notes...

Demolitions

In the interest of the safety of the general public, occupiers and adjacent building owners, most buildings to be demolished are subject to legal requirements administered by the Building Control Division.

In most instances if you wish to demolish a building or part of a building, you are required to notify the Local Authority in writing, giving six weeks notice under Section 80 of the Building Act 1984. A copy of the notice should also be sent to other interested parties, such as the local gas and electricity authorities.

The demolition work should not start until:-

  • i. A notice under Section 81 of the Building Act has been received or
  • ii. A period of six weeks has elapsed without a notice under Section 81 being
  • received
  • and if required.
  • iii. Consent has been received from the Planning Control Division.

During the demolition process, in addition to the usual health and safety requirements, all conditions and works listed in the Section 81 Notice must be carried out. You have a right of appeal against any requirement, however, in these circumstances, you are advised to seek professional advice.

Failure to give notice under Section 80 or failure to comply with a notice under Section 81 is an offence under the Building Act 1984.

Anyone intending to demolish a building or part of a building exceeding 50 cubic metres in volume is required to notify us. Please use the online form below or print out the Demolition form which should be completed and returned to us along with a site plan, method statement and certificate of insurance. No fees are payable.
