Why do I need a licence?
Street trading is defined as the selling or offering for sale of any article in the street. This includes:
- Food items such as burgers, kebabs and doughnuts.
- Non food items to include jewellery, household items, the sale of memberships to organisations i.e. AA, face painting and hair braiding etc.
Street Trading excludes markets, news vendors, trading in connection with a shop or petrol station, door to door delivery rounds and pedlars acting under Pedlars act 1871.
Burton is divided into consent streets and prohibited streets for street trading. A consent street is where mobile trailers can only sell goods where they have the benefit of a consent issued by East Staffordshire Borough Council. A prohibited street is one where no mobile trailers are allowed to sell goods. If a street is neither consent nor prohibited the council have no jurisdiction in issuing consents.
East Staffordshire have 7 designated pitches in Burton Town Centre these are situated on Station Street (High Street to Worthington Way).
All other streets in East Staffordshire are prohibited for trading unless special consent is granted in exceptional circumstances.
If someone wishes to apply for a street trading consent they will not be allowed to sell the same items as someone already trading in that street.
If someone wants to trade on private land they do not require a consent from Licensing but must contact the land owner for permission and may also need check with the planning and environmental health department for any additional requirements.
Must I meet a certain criteria before I can apply for a licence?
You must be over 17 years of age to hold a licence.
Licences will be refused if any of the following grounds exist:
- there isn't enough space in the street you wish to trade in, without causing interference or inconvenience to street users
- you are unsuitable to hold a licence do to any previous convictions or for other reasons

What conditions are attached to the licence once issued?
East Staffordshire Borough Council will issue standard conditions relating to Street Trading Consents.
How will my application will be determined?
To make an application, you will need to provide us with the following:
- a completed application form
- application fee
- recent photograph of the applicant
- photograph or drawing of the trailer you wish to trade from (new applications only)
A copy of the application should also be served on Staffordshire Police at Burton Police Station, Horninglow Street, Burton upon Trent, Staffordshire, DE14 1PA.
Once the application is received, the Licensing Team will consult with the following:
- Staffordshire County Council
- Environmental Health
- Enforcement Team
If any objections are received the matter will be referred to the Council’s General Licensing Sub Committee for consideration.
Having considered all of the factors of an application the Council would either decide to grant or refuse the licence

How long will it take to process my application?
We will endeavour to process your application within 20 working days. If acknowledgement of receipt of your application has not been received within this time, please contact us.
Will tacit consent apply?
Yes. This means that you will be able to act as though your application is granted if you have not heard from the local authority by the end of the target completion period.
If my application is refused how do I appeal?
Please contact us in the first instance for details of how to appeal.
How do I tell you about a change that may affect my license?
You must notify us in writing of any changes to your current license.
