Gaming Machine Permits - Licensed Premises
An existing Section 34 permit will continue to have effect as if it were a licensed premises gaming machine permit issued under the new Act.
Under the Gambling Act, pubs will have an automatic entitlement to two gaming machines (Category C or D), subject to a simple notification procedure to this Authority. This should be done prior to the expiry of the existing Section 34 permit. (See annex 1 for gaming machines categories)
Should you wish to offer more than two gaming machines you will need to apply for a licensed premises gaming machine permit. This should be done prior to the expiry of the existing Section 34 permit.
The automatic entitlement and licensed premises gaming machine permit will be of unlimited duration. You will not need to apply again unless your circumstances change. If the Premises Licence issued under the Licensing Act 2003, is transferred you will need to submit another notification or apply to transfer the existing licensed premises gaming machine permit.
Holders of licensed premises gaming machine permits will be required to pay an annual fee.
It is important to note that this section relates to premises with an ‘on-premises’ alcohol licence issued under the Licensing Act 2003 that authorises the sale of alcohol without the requirement to serve food.
Pubs, restaurant or hotels will be able to notify/apply for a permit, but only if they have a bar. Hotels and restaurants that are only permitted to sell alcohol as an accompaniment to food will not be able to provide gaming machines on the premises.
