Alcohol Designation Orders
What is an Alcohol Designation Order?
The Criminal Justice and Police Act 2001 gives local authorities the powers to designate public areas through the introduction of an Alcohol Designation Order where it is believed that a nuisance or disorder is associated with the consumption of alcohol.
It is an offence once an Order is in place to drink alcohol after being required by a police officer not to do so.
The Police can require a person not to consume alcohol or to surrender it in a named public place. Failure to comply is an arrestable offence and may result in a fine, not exceeding £500.
Alcohol Designation Orders are just one of a number of tools used by Local Authorities to combat anti-social behaviour.
It should be noted that the order only relates to public places but not to:
- Any premises to which a premises licence or a club premises certificate under the Licensing Act 2003 applies or the curtilage thereof;
- Any premises which by virtue of Part 5 of the Licensing Act 2003 may for the time being be used for the supply of alcohol or could have been so used within the last twenty minutes;
- Any place where facilities relating to the sale or consumption of alcohol are permitted under Section 115 E Highways Act 1980.
Areas that currently have an Alcohol Designation Order in place are:
- Rolleston
- Short Street, Stapenhill
- Canterbury Road, Winshill
- The Green, Brizlincote Valley, Stapenhill
- King Edward Place, Burton upon Trent
- Collinson Park, Barton under Needwood
- Oak Road Shopping Arcade, Barton under Needwood
- Anglesey, Burton upon Trent
- The Link Park (Off Shobnall Road)
New area that has received approval:
Horninglow Basin, Burton upon Trent (Between Princess Way, Stretton and Shobnall Leisure Complex Foot Bridge via the Canal and Footpath)
Consultation has now taken place and the order approved by the General Licensing Sub Committee.
The Order will come into effect on 7th May 2012.
